Asylum procedure

Foreigners are entitled to enter the territory of the Federal Republic of Germany for the purpose of seeking asylum. The Federal Office for Migration and Refugees (BAMF) rules on the approval of applications for asylum. You will receive further information by clicking on the link below.

For as long as the procedure is ongoing, the alien will be issued with a certificate of residence permission: gainful employment is admissible only during the course of the procedure where the Immigration Office has issued the appropriate work permit, the asylum-seeker has been living in the Federal Republic of Germany for one year and the Federal Employment Agency has approved the employment.
Once asylum has been granted, the Immigration Office will issue a residence permit.
Applicants who have been refused asylum and who are not yet in a position to return to their native countries are issued with a certificate of toleration. A certificate of toleration does not represent confirmation of right of residence but, as defined by the law, is merely confirmation of the fact that the requirement that residence be discontinued has been waived temporarily.

A certificate of toleration may suffice for the Immigration Office to issue a work permit in so far as the holder has been living in the Federal Republic of Germany for one year and the Federal Employment Agency has approved employment.
